From Inside Higher Education: “Ray Li, who previously worked as an attorney in the Office for Civil Rights, said the tone of the FAQ differs radically from that of the Feb. 14 Dear Colleague letter. … The FAQ appears to be ‘a kind of a retrenchment back to legal principles. It’s much more grounded in legal analysis.’ He noted that the document sticks more closely to describing what’s in the SFFA decision … and, as is typical for the Office for Civil Rights, promises to ‘examine the facts and circumstances of each case.’ While the FAQ still contends that ‘many schools have advanced discriminatory policies and practices under the banner of ‘DEI’ initiatives,’ it also says the label ‘DEI’ doesn’t automatically make a program in violation of civil rights law.”
